AGB
1. Scope
These General Terms and Conditions (AGB) apply to all contracts between Caspino Food Trading, represented by Managing Director Ehsan Abbassi, Prinzenstr. 30B, 12105 Berlin (hereinafter referred to as “the Seller”), and its customers (both retail and wholesale).
2. Subject of the Contract
Caspino Food Trading sells food products such as dates, raisins, and similar goods. Sales are made to both business customers (B2B) and end consumers (B2C).
3. Conclusion of the Contract
A contract is concluded through a written order by the customer via email or telephone and an explicit order confirmation by the seller.
4. Prices and Payment Terms
– Prices are available upon request and are agreed upon individually.
– All common payment methods (e.g., advance payment, invoice, PayPal, credit card) are accepted.
– Payment must be made within the agreed period.
5. Delivery and Shipping
– Delivery is made to all EU countries except the United Kingdom, Switzerland, and Norway.
– Shipping costs and delivery times depend on the destination and are agreed individually.
– The risk of accidental loss or deterioration of the goods passes to the customer upon handover to the shipping provider.
6. Right of Withdrawal and Returns
As these are food products, there is no right of withdrawal in accordance with § 312g para. 2 no. 2 BGB. Returns are excluded.
7. Warranty and Liability
– The goods must be inspected immediately upon receipt for any damage or defects.
– Complaints must be reported in writing within 24 hours of receipt.
– The seller accepts no liability for damage caused by improper storage or handling.
8. Final Provisions
– German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
– The place of jurisdiction for all disputes is Berlin.
